These Terms of Service (“Terms”) govern your access to and use of the BROOMSTICK mobile application, website, and related services (collectively, “BROOMSTICK,” “the App,” “we,” “us,” or “our”).
By accessing or using BROOMSTICK, you agree to these Terms. If you do not agree, do not use BROOMSTICK.
BROOMSTICK is independently operated and is not affiliated with, endorsed by, or sponsored by the City of Salem, Massachusetts, unless explicitly stated otherwise.
1. Purpose of BROOMSTICK
BROOMSTICK is an informational guide intended to help users explore Salem, Massachusetts.
BROOMSTICK may include information regarding attractions, museums, restaurants, parking, restrooms, events, wait times, crowd levels, directions, maps, business links, ticket links, HOUSE ARAUZ YouTube links, support links, and other visitor information.
BROOMSTICK is provided for general informational and convenience purposes only.
2. No Guarantee of Accuracy, Availability, or Suitability
BROOMSTICK does not guarantee that any information in the App is accurate, complete, current, reliable, available, suitable, or error-free.
Information may be incorrect, outdated, delayed, incomplete, unavailable, changed without notice, or based on estimates. This includes hours, closures, business status, attraction details, event details, ticket availability, prices, restroom access, parking access, parking rates, restrictions, crowd conditions, wait times, line length, directions, map accuracy, seasonal availability, amenities, and accessibility information.
You are solely responsible for independently confirming any information that matters to you before relying on it.
3. No Responsibility for Closures, Inaccuracies, or Conditions
BROOMSTICK is not responsible if a business or attraction is closed, an event is canceled or sold out, hours are incorrect, parking is unavailable, a restroom is inaccessible, directions are inaccurate, an address or amenity changes, a place is more or less crowded than expected, a line is longer or shorter than expected, or your experience does not meet expectations.
Use of BROOMSTICK is entirely at your own risk.
4. Wait Times and Crowd Levels Are Estimates Only
Any wait-time, line, or crowd-level information shown in BROOMSTICK is an estimate only and may be based on user reports, recent reports, limited data, automated calculations, aggregation logic, or no recent data at all.
BROOMSTICK does not guarantee that any posted wait time, wait estimate, crowd level, line indicator, or Downtown Salem status reflects actual real-time conditions.
Actual conditions may differ significantly. BROOMSTICK is not liable for inconvenience, cost, delay, missed opportunity, disappointment, or decisions made in reliance on wait-time or crowd information.
5. User Wait-Time Reports
BROOMSTICK may accept user-submitted wait-time or crowd reports. We do not guarantee that user-submitted information is truthful, accurate, timely, or reliable.
We may reject, limit, aggregate, ignore, remove, or expire reports and may apply anti-abuse controls. You agree not to intentionally submit false information, manipulate crowd levels, submit duplicate reports to distort results, falsify your location, or bypass proximity and anti-abuse requirements.
6. Location-Based Features
Some features may rely on location services for proximity verification, directions, distance calculations, maps, or wait-report eligibility.
BROOMSTICK makes no guarantee that location-based features, map features, distance calculations, or route guidance will be accurate or available.
You are responsible for using your own judgment and complying with all laws, signs, restrictions, closures, and safety conditions.
7. Parking Information Disclaimer
Parking information in BROOMSTICK is informational only. Unless explicitly stated otherwise, BROOMSTICK does not provide verified live parking-space availability.
If capacity is shown, it refers only to a facility’s approximate or known maximum capacity and not current open spaces.
BROOMSTICK is not responsible for unavailable parking, incorrect rates, towing, fines, tickets, time-limit violations, temporary closures, changed rules, permit restrictions, EV charger availability, inaccurate directions, or any loss or damage connected to parking decisions.
You are solely responsible for obeying official signage, posted rules, payment requirements, restrictions, and local laws.
8. Restroom Information Disclaimer
Restroom information is provided as a convenience only. Restrooms may be public, limited, seasonal, conditional, inside another facility, unavailable, inaccessible, out of order, restricted, or closed without notice.
BROOMSTICK is not responsible if a restroom listing is inaccurate, unavailable, inaccessible, unsuitable, or changed. Any warning or advisory is informational only and may change over time.
9. Events Disclaimer
BROOMSTICK may display selected events, but does not guarantee that any event information is complete, current, accurate, or available.
Events may be changed, moved, postponed, sold out, canceled, or incorrectly listed. You must verify event details directly with the event organizer or official event source.
10. Third-Party Links, Tickets, Reservations, and Purchases
BROOMSTICK may contain links to third-party websites, ticket providers, reservation systems, map services, YouTube, Venmo, businesses, event pages, and other external services.
BROOMSTICK does not collect, handle, or control payment details used on third-party websites.
Any purchase, booking, donation, reservation, or ticket transaction is solely between you and the third party.
BROOMSTICK is not responsible for third-party websites, content, pricing, availability, ticketing issues, refunds, cancellations, booking errors, reservation disputes, fraud by third parties, payment processing, financial losses, or third-party privacy and security practices.
11. HOUSE ARAUZ and Other External Media
BROOMSTICK may include links to the HOUSE ARAUZ YouTube channel or specific YouTube videos. These links are provided for convenience only.
BROOMSTICK is not responsible for the availability, operation, content, policies, playback quality, or behavior of YouTube or any external media platform.
12. Support / Donation Links
BROOMSTICK may include optional support or donation links, such as Venmo.
Any support or donation is voluntary. BROOMSTICK does not guarantee any product, benefit, special access, special treatment, or service level in exchange for voluntary support unless explicitly stated.
All support or donation transactions are handled by the third-party payment provider, not BROOMSTICK.
13. Maps, Navigation, and Directions Disclaimer
Maps, distances, pins, locations, and directions are provided for convenience only and may be inaccurate, outdated, incomplete, unavailable, or unsuitable for your intended route.
BROOMSTICK is not responsible for navigation errors, inaccessible routes, unsafe routes, traffic, construction, parking access issues, walking-route issues, location mismatches, entrance differences, or GPS problems.
Always use your own judgment and follow official signs, local laws, and current conditions.
14. No Professional, Safety, or Legal Advice
BROOMSTICK does not provide legal, safety, accessibility, travel, business, medical, or professional advice.
Nothing in BROOMSTICK should be treated as an official instruction, guaranteed accessibility statement, official city guidance, or legally binding representation.
15. Use at Your Own Risk
You use BROOMSTICK voluntarily and entirely at your own risk.
You are solely responsible for your actions, decisions, travel plans, reservations, purchases, route choices, parking decisions, attendance decisions, and reliance on any information shown in the App.
16. Acceptable Use
You agree not to misuse the App, attempt unauthorized access, interfere with the App or its servers, falsify reports, manipulate wait times or crowd information, bypass protections, use the App for unlawful purposes, introduce malicious code, or otherwise abuse the service.
We may suspend, block, or restrict access if we believe the service is being abused.
17. Intellectual Property
BROOMSTICK’s branding, design, content, and software are owned by or licensed to BROOMSTICK unless otherwise stated.
Third-party names, brands, business names, logos, event names, and other content remain the property of their respective owners. Inclusion in BROOMSTICK does not imply endorsement, ownership, or affiliation.
18. Disclaimer of Warranties
To the fullest extent permitted by law, BROOMSTICK is provided “as is,” “as available,” and “with all faults.”
BROOMSTICK disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, reliability, availability, uninterrupted operation, and error-free operation.
19. Limitation of Liability
To the fullest extent permitted by law, BROOMSTICK and its owner/operator shall not be liable for any direct, indirect, incidental, consequential, special, exemplary, punitive, or other damages arising out of or related to your use of, inability to use, or reliance on BROOMSTICK.
This includes losses arising from inaccurate information, closed businesses or attractions, changed hours, canceled events, missed events, incorrect wait times, crowd inaccuracies, parking problems, restroom access issues, navigation issues, ticket problems, reservation problems, third-party transactions, technical failures, data delays, outages, lost time, lost money, lost opportunities, dissatisfaction, inconvenience, or disappointment.
If, despite the foregoing, BROOMSTICK is found liable for any claim, then to the fullest extent permitted by law, BROOMSTICK’s total liability to you shall not exceed the greater of the amount you paid directly to BROOMSTICK for the specific service at issue or $50 USD.
Because BROOMSTICK is a free informational service, this limitation is a material basis of these Terms.
20. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless BROOMSTICK and its owner/operator from and against claims, demands, liabilities, damages, losses, costs, and expenses, including reasonable attorneys’ fees, arising from your use or misuse of the App, your violation of these Terms, your reliance on third-party services accessed through the App, or your submitted content or reports.
21. Changes to the App
We may update, change, suspend, restrict, or discontinue all or any part of BROOMSTICK at any time, with or without notice.
We are not liable for any modification, suspension, or discontinuation of the App or any feature.
22. Changes to These Terms
We may revise these Terms from time to time. The updated version will become effective when posted, unless otherwise stated.
Your continued use of BROOMSTICK after updated Terms are posted means you accept the updated Terms to the extent permitted by law.
23. Governing Law
These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law principles, except where otherwise required by law.
24. Severability
If any part of these Terms is found unenforceable, the remaining provisions will remain in full force and effect to the extent permitted by law.
